1. Purpose and Scope
This Acceptable Use Policy (“AUP”) sets out rules for using Numidia (the “Service”), provided by Numidia Analytics LLC (“Numidia”). It applies to every Customer and User and is part of the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
Customers are responsible for ensuring their Users and anyone they allow to use the Service comply with this AUP. The examples below are not exhaustive; Numidia may treat any use that is similar in purpose or effect as a violation.
2. Unlawful, Harmful and Prohibited Content
You must not use the Service to create, store, process, display, send or share content or data that:
- is illegal, or promotes or facilitates illegal activity;
- infringes or misappropriates any intellectual property, privacy, publicity or other right of any person;
- is defamatory, fraudulent, deceptive or misleading, including phishing, impersonation and false representations of affiliation;
- is harassing, threatening, abusive, hateful or incites violence or discrimination against any person or group;
- sexually exploits or endangers minors, in any form;
- contains viruses, malware, ransomware or other harmful code;
- consists of personal data you have no lawful basis to process, or data obtained in breach of any law or third-party terms; or
- is protected health information, payment card data, government identification numbers or other sensitive data, unless Numidia has agreed in writing to that specific use.
3. Email and Messaging Rules
Email campaigns are sent from domains you verify, using infrastructure that Numidia and its email delivery provider share with other customers. To protect deliverability for everyone, you must:
- send only to recipients who have given any consent the law requires and who have a reasonable expectation of hearing from you; you must not use purchased, rented, scraped, harvested or third-party lists;
- comply with all applicable laws, including the U.S. CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), the EU and UK GDPR and ePrivacy rules, and the U.S. Telephone Consumer Protection Act where relevant;
- include a working unsubscribe mechanism in every commercial message and honour opt-outs promptly, and never re-add someone who has unsubscribed without fresh consent;
- identify yourself accurately, use truthful subject lines and headers, and include a valid physical postal address where the law requires it;
- send only from domains you own or are authorized to use, and never spoof or impersonate another sender;
- keep bounce and complaint rates within the thresholds Numidia or its providers publish from time to time; and
- not send content promoting illegal goods or services, gambling where unlawful, adult content, pyramid or get-rich-quick schemes, or malware.
Numidia may pause any campaign or sending domain that shows signs of spam, unusually high bounces or complaints, or a risk to shared sending reputation, while it investigates.
4. Data and Privacy Rules
- Import, connect or store personal data only where you have a lawful basis and have given any notices the law requires.
- Connect only systems, accounts and databases you are authorized to connect, and grant the Service only the access it needs.
- Do not use the Service to track, profile or surveil individuals unlawfully, or to make decisions that unlawfully discriminate against anyone.
- Do not use public dashboard share links to publish personal data or confidential information you are not entitled to publish.
5. Recording and Transcription Consent
- Before recording, transcribing or uploading any conversation, give every participant the notice and obtain the consent that the law requires; where any participant is in an all-party consent jurisdiction, obtain consent from all participants.
- Never record a conversation covertly, or record anyone who has objected.
- Do not record or upload conversations whose content you are not entitled to process, such as privileged or legally restricted communications, unless you are authorized to do so.
6. AI Features
When using AI features, you must not:
- attempt to extract, reveal or reconstruct Numidia’s prompts, system instructions, model configurations or other non-public parts of the Service, including through prompt injection or jailbreak techniques;
- use AI features or Output to build, train, fine-tune or evaluate any AI or machine learning model or product that competes with the Service;
- generate content that violates Section 2 of this AUP, or the usage policies of Numidia’s AI providers;
- present Output as human-generated where that would deceive people in a way that causes harm, or rely on Output for legal, medical, financial or other high-stakes decisions without qualified human review; or
- use AI features to make automated decisions with legal or similarly significant effects on individuals without meaningful human review and any notices or rights the law requires.
7. Security and Abuse
You must not:
- probe, scan, penetration-test or test the vulnerability of the Service or its infrastructure without Numidia’s prior written authorization;
- attempt to access another customer’s data, account or tenant, or any data or system you are not authorized to access;
- breach or bypass authentication, access controls, tenant isolation, rate limits, plan limits or AI credit metering;
- overload, flood or disrupt the Service, including through denial-of-service attacks or excessive automated requests;
- use the Service to attack, probe or gain unauthorized access to any other system or network; or
- use the live database query feature to connect to databases you do not own or are not authorized to query, or to run queries designed to harm the Service or the connected database.
If you believe you have found a security vulnerability, report it to help@numidia.io and do not access, modify or disclose data beyond what is necessary to demonstrate it. Numidia will not pursue legal action against good-faith reports that follow this paragraph.
8. Scraping, Copying and Competitive Use
You must not:
- scrape, crawl or extract data or content from the Service by automated means, except through export features Numidia provides;
- copy, frame, mirror, reverse engineer or decompile the Service, or imitate its design, features or workflows;
- access the Service to build or help build a competing product, or for competitive benchmarking or analysis, without Numidia’s written consent; or
- use the web-page import feature to collect data from websites in breach of their terms, robots instructions or the law.
9. Accounts and Resale
- Do not share login credentials, let more than one person use a seat, or create accounts with false information or by automated means.
- Do not create multiple accounts or trials to evade plan limits, fees or enforcement.
- Do not resell, sublicense, white-label or provide the Service to third parties.
10. Reporting Violations
To report a suspected violation of this AUP, including spam sent through the Service or unlawful content on a public share link, email help@numidia.io with as much detail as you can, such as the message headers or URL. Copyright complaints should follow the process in the Terms of Service.
11. Enforcement
Numidia may investigate any suspected violation of this AUP and may monitor use of the Service to detect violations. If Numidia determines, in its reasonable judgment, that a violation has occurred or is likely, it may, with or without notice and in addition to any other remedy:
- remove, disable or restrict access to content, share links, campaigns or sending domains;
- suspend or limit features, Users or the whole account;
- terminate the subscription under the Terms of Service, without a refund;
- report the activity to law enforcement or affected third parties and cooperate with their investigations; and
- seek damages, injunctive relief and recovery of its costs.
Numidia has no obligation to monitor content and is not responsible for content Customers and Users submit, but may act on any violation it becomes aware of.
12. Changes
Numidia may update this AUP from time to time to address new risks, laws or features. Updates take effect when posted with a new “Last updated” date, and Numidia will give notice of material changes as described in the Terms of Service. Questions about this AUP can be sent to help@numidia.io.
